Dictionary Definitions
- n., 1. One should always keep in mind that one of the purposes of the copyright legislation, historically, has been “to protect and reward the intellectual effort of the author (for a limited period of time) in the work”. (my emphasis). The use of the word “copyright” in the English version of the Act has obscured the fact that what the Act fundamentally seeks to protect is “le droit d’auteur”. While not defined in the Act, the word “author” conveys a sense of creativity and ingenuity. 2. “...[T]he person who expressed the ideas in an original or novel form:…” 3. Includes the legal representatives of a deceased author. [The Dictionary of Canadian Law, 3rd ed. c2004]
- n., Copyright. The person who creates an expressive work, or the person or business that hires another to create an expressive work. In copyright law, “author” applies to a broad range of occupations, including writers, artists, programmers, choreographers, and translators. 2. One from whom a right or title derives in some way other than by descent. [Black’s Law Dictionary, 8th ed. c2004]
- n., The physical or juridical person having the authority and capacity to issue the record or in whose name or by whose command the record has been issued.
